The financial effect can be substantial. On a ₹2 crore CIF shipment, a classification-related duty difference of only 2% represents ₹4 lakh before considering any further tax impact. If the revised classification also triggers a regulatory requirement, the cost can increase further through delay, storage and operational disruption.

This is why the classification file should be built using technical evidence rather than copied from the supplier invoice. Ideally, the importer should have the technical catalogue, product photographs, model details, operating specifications and a clear description of what the product actually does.

For high-value or regulated imports, the 8-digit HS Code should therefore be treated as a commercial control point, not only a Customs declaration field.

Why Last Year’s HS Code Should Not Automatically Be Reused

Previous import history can be helpful, but it should not be treated as permanent evidence that the classification and compliance position are still correct.

Tariff lines and policy conditions can change. Product specifications can also change even when the supplier keeps the same broad commercial product name. A new model may contain additional wireless functionality, a different component structure or another feature that changes the regulatory assessment.

That is not correct.

The reverse can also be important. If an item is Restricted, the importer may need DGFT authorisation before the shipment can be treated as commercially ready.

For companies importing 100 or 500 different SKUs, a simple internal compliance sheet can be valuable. It can record the HS Code, duty structure, DGFT policy, regulator, certificate number, certificate validity and document requirements.

This reduces the risk of repeating the same compliance investigation for every shipment and helps purchasing, logistics and Customs teams work from the same information.

BIS Compliance Should Be Checked Against the Exact Product

BIS is one of the most commonly misunderstood areas of import compliance.

Some importers assume that every electronic product requires BIS. Others assume industrial-use equipment automatically falls outside compulsory certification. Neither assumption is reliable.

Applicability depends on whether the exact product is covered under a notified compulsory certification requirement and whether any applicable exemption or special condition applies.

The importer therefore needs to review the exact product name, functionality, model and applicable Indian Standard rather than making the decision from the broad HS heading alone.

Current 2026 changes provide a useful example. Specified non-USB standalone hard disk drives have a compliance implementation date of 5 November 2026. Wireless functionality can create another regulatory layer that is easy to miss during purchasing.

A product may be commercially described as a speaker, scanner, machine controller, camera, sensor or industrial device, but if it contains applicable Wi-Fi, Bluetooth or another radio-frequency function, the importer may need to evaluate WPC requirements.

The current WPC Equipment Type Approval process includes a government application fee of approximately ₹10,000 under the relevant route and can require an RF test report, technical literature and manufacturer authorisation where applicable.

The ₹10,000 itself is rarely the biggest commercial risk.

The timing is usually more important.

Consider an importer purchasing ₹80 lakh of wireless electronics and paying a 30% supplier advance. The business has already committed ₹24 lakh before production is complete. If the WPC requirement is discovered only after the supplier packs the cargo, the importer now has money committed, a supplier demanding shipment instructions and potentially a customer delivery deadline.

If the same issue had been identified 45 or 60 days earlier, the approval process could have progressed while manufacturing was underway.

For wireless products, procurement teams should therefore obtain RF specifications and relevant test information before final shipment approval.

MTCTE and WPC Should Not Be Treated as the Same Requirement

Another common mistake is assuming that WPC approval covers all compliance requirements for telecom or network equipment.

WPC and MTCTE serve different regulatory purposes.

WPC addresses applicable radio-frequency and wireless approval requirements. MTCTE relates to conformity requirements for notified telecom equipment.

Depending on the product, the importer may therefore need to examine both.

The scale of the current certification environment shows why this matters. As of August 2026, the MTCTE system displayed approximately 5,403 certificates covering more than 11,000 certified models.

Consider an enterprise wireless router. The procurement team may confirm that the radio-frequency specification has been reviewed for WPC purposes. That does not automatically answer whether the equipment also falls within the current MTCTE scope.

The current application framework runs until 15 December 2026, while authorisations issued under the 2026 system can remain valid up to 31 December 2026.

This means an importer purchasing servers should not stop after checking the duty or BIS status.

The compliance review may also need to examine the DGFT import-management requirement and potentially wireless or telecom requirements depending on the equipment configuration.

Consider a ₹2 crore server procurement project. If the purchasing team checks only freight cost and Customs duty but fails to confirm the import-management requirement, the entire shipment can become operationally difficult despite being standard commercial IT hardware.

This is why high-value IT procurement should use a model-level compliance matrix before supplier dispatch.

FSSAI Requirements for Food and Food Ingredient Imports

Food imports follow a different compliance path from general industrial cargo.

Correct HS classification and payment of Customs duty do not automatically complete the clearance process if the product falls within the FSSAI import framework.

A phytosanitary certificate, health certificate or other origin-issued document cannot always be created retrospectively after the shipment reaches India.

Consider a shipment that spends 18 days at sea. The importer discovers after arrival that a required certificate should have been issued by the exporting country’s competent authority before departure.

The logistics team may now have a container physically sitting in India but no simple way to reconstruct the missing compliance document.

This is one of the strongest reasons to identify product-specific requirements before booking.

The pre-shipment checklist should clearly separate documents that can be arranged after departure from those that must exist before export.

Any document in the second category should become a mandatory shipping-release condition.

For technical products, physical verification can involve comparing the actual model, serial number, technical specification or nameplate details with the declaration.

Suppose an importer declares a wireless device under one model number, but the cartons show a different model suffix. Even where the product is commercially similar, Customs may ask whether the certificate and declaration remain applicable.

This is why importers should focus less on predicting whether examination will occur and more on ensuring that the physical goods match the paperwork.

A strong technical and regulatory file reduces the time required to answer questions if the shipment is selected.

How a Wrong HS Code Can Create a Cargo Hold

An incorrect HS Code can create more than a duty problem.

The first impact may be a change in Basic Customs Duty or another levy. The second may be a change in import policy. The third can be a completely different product-regulation pathway.

For example, the importer may believe the goods fall under a freely importable tariff line. During assessment, Customs may question the classification and consider another entry with an additional compliance requirement.

Now the issue is no longer only tax.

The importer needs to investigate whether another licence or certificate is required while the cargo is already at destination.

On a ₹1 crore shipment, even a 3% duty difference represents ₹3 lakh. If the classification dispute also delays release by 5 days at an equipment tariff of ₹22,200 per day, another ₹1.11 lakh can be added before storage and operational costs.

This is why classification accuracy should be treated as both a Customs issue and a logistics-risk issue.

How Missing Compliance Documents Create Cargo Holds

Some compliance documents can be resolved relatively quickly after shipment. Others cannot.

The most dangerous requirements are documents or certificates that should have been obtained at origin before the goods were dispatched.

If Customs or another regulator requests one of these documents after arrival, the importer may need support from the overseas supplier, laboratory or government authority.

That can take days or weeks.

Consider a ₹75 lakh shipment sitting in a CFS while the overseas supplier tries to obtain a document that should have been arranged before export.

Every additional day can create storage, detention, handling and customer-delay costs.

The pre-import assessment should therefore classify each compliance document according to timing.

The business should know which items are mandatory before purchase, which must be ready before shipment and which can be completed during pre-arrival Customs preparation.

That timing matrix can prevent a small paperwork issue from becoming a large destination cost.

Cost of a Compliance Delay After Arrival

A generic statement that demurrage or detention is always ₹7,000 to ₹15,000 per day does not accurately represent all shipments.

Carrier charges vary by equipment type and time slab.

One current 40-foot dry-container tariff example provides approximately 4 free import days. The rate then increases to approximately ₹11,800 per day for days 5 to 10, ₹16,800 for days 11 to 14, ₹19,500 for days 15 to 17 and approximately ₹22,200 per day from day 18 onward.

At ₹22,200 per day, a 3-day delay creates approximately ₹66,600 of equipment exposure.

A 5-day delay creates approximately ₹1,11,000.

These figures do not include CFS storage, documentation charges, additional Customs broker work or domestic transport rescheduling.

If the imported goods are production-critical, the commercial loss can be significantly higher than the logistics charge itself.

1. ₹80 Lakh Wireless Electronics Import

Consider an importer purchasing ₹80 lakh of Wi-Fi-enabled electronics from an overseas manufacturer.

The company pays a 30% advance of ₹24 lakh and expects the goods to be ready in 45 days.

The purchasing team checks the supplier’s HS Code and negotiates the freight rate but does not complete the WPC assessment.

After production is finished, the supplier asks for final air-freight instructions.

The import team now discovers that the product’s RF functionality needs to be reviewed and the supporting test information must be collected.

The government application fee itself may be only around ₹10,000 under the applicable route, but the importer now has ₹24 lakh already committed and an urgent customer delivery schedule.

If the review had happened when the purchase order was issued, the compliance work could have run during the 45-day manufacturing period.

The key lesson is that compliance should be integrated into procurement, not added at the end of logistics planning.

2. Old HS Code Used for a 2026 Shipment

Consider a manufacturer that imported one model of industrial electronics successfully in 2025.

In 2026, the business orders another model from the same supplier and automatically uses the previous HS Code.

The purchasing team believes the products are substantially similar.

However, the new model includes an additional wireless communication feature, and import regulations have also received updates during 2026.

The Customs broker notices the difference only when the shipping documents are being prepared.

The container is already booked.

The importer now needs to reconsider classification, regulatory applicability and documentation while the cargo is moving toward India.

This situation is avoidable.

Previous shipments should be used as reference material, but every new or materially changed product should still receive a current compliance review.

3. Five-Day Compliance Hold at Port

Consider a 40-foot container carrying ₹1.2 crore of imported equipment.

The vessel arrives on schedule, but Customs identifies that the model shown on the commercial invoice does not clearly match the model referenced on the regulatory certificate.

The importer needs 5 days to obtain clarification and updated documentation from the overseas manufacturer.

If the container has entered a tariff slab of approximately ₹22,200 per day, the 5-day equipment exposure alone reaches ₹1.11 lakh.

Assume another ₹30,000 is spent on CFS handling and documentation.

Now assume the factory installation team loses one working day worth approximately ₹3 lakh.

The total illustrative impact is around ₹4.41 lakh.

The original issue may have been a model-description mismatch that could have been detected before shipment.

This is why pre-import compliance assessment should be viewed as cost prevention rather than paperwork.

Air Freight Compliance Needs to Be Checked Before Booking

Air freight is normally chosen because time matters.

That means compliance errors are especially expensive.

A company may pay a substantial premium to move a critical electronic component from China to India in 3 or 4 days instead of using sea freight.

If the shipment then remains pending for another 5 days because BIS, WPC, MTCTE or another approval is missing, the business has paid for speed without receiving the operational benefit.

Battery-powered products can create another layer.

From January 1, 2026, specified lithium-ion cells and batteries packed with equipment under the applicable PI 966 provisions are subject to a maximum 30% state-of-charge requirement for air transport, subject to the detailed provisions and exceptions.

This is a transport-safety requirement, not an Indian Customs approval.

The distinction is important because a product can be legally importable but still not be accepted by the airline in its current shipping condition.

For urgent air cargo, regulatory readiness and transport readiness should both be confirmed before space is booked.

Sea Freight Compliance Should Be Completed Before Sailing
