1. Introduction & Definitions

Cargo People operates as an international freight forwarder and logistics solutions provider headquartered in India. Our services are designed for importers, exporters, manufacturers, traders, SMEs, and large corporates. To avoid ambiguity, the following definitions apply:

  • “Customer”: Any individual or business entity using Cargo People’s services.
  • “Services”: Includes air freight, sea freight (FCL/LCL), customs clearance, warehousing, distribution, door-to-door delivery, and project cargo handling.
  • “Carrier”: Airlines, shipping lines, trucking companies, or third-party providers engaged to transport cargo.
  • “Force Majeure”: Events beyond reasonable control, such as natural disasters, strikes, wars, pandemics, cyber-attacks, or government restrictions.
  • “Agreement”: Refers to these Terms & Conditions, including updates posted on our website.

2. Scope of Services

We offer customized logistics solutions across air, sea, and land transport. While we strive to ensure efficiency, all services are subject to carrier schedules, customs regulations, and external conditions beyond our control.

Our services include:

  • Air freight forwarding (express, standard, and charter services).
  • Sea freight (FCL, LCL, consolidated shipments).
  • Customs clearance and regulatory compliance in India and abroad.
  • Warehousing, storage, and bonded facilities.
  • Project cargo handling for oversized and specialized shipments.
  • Door-to-door delivery and inland transportation.

Important notes:

  • We act as an agent/facilitator, not as the carrier or insurer of goods.
  • Rates are dynamic and subject to changes in fuel prices, currency fluctuations, and surcharges.
  • We do not guarantee exact delivery times as they depend on carriers, ports, and customs authorities.

3. Quotations, Pricing & Validity

Our quotations are carefully prepared based on the information provided by customers. However, all quotes are subject to change in line with global market conditions.

Key conditions:

  • Quotes are valid for 15 calendar days unless otherwise specified.
  • Quotes exclude taxes, duties, storage charges, and penalties unless expressly included.
  • Any change in cargo weight, volume, or description may lead to revised charges.
  • Cargo People reserves the right to pass on unforeseen costs like emergency surcharges, bunker adjustments, or port charges.

4. Customer Responsibilities

Customers play an active role in ensuring smooth shipping operations. Failure to comply with requirements can result in delays, penalties, or shipment rejection.

Customer obligations include:

  • Providing accurate and complete documents (invoice, packing list, HS code, export/import license if applicable).
  • Declaring hazardous or restricted cargo truthfully.
  • Complying with DGFT, CBIC, IATA, IMO, and international trade laws.
  • Arranging cargo insurance independently unless agreed otherwise.
  • Indemnifying Cargo People against losses or fines arising from mis-declared or illegal cargo.

5. Payments, Invoicing & Additional Charges

Logistics operations involve multiple stakeholders, and payment terms must be respected for uninterrupted services.

Payment terms:

  • Invoices must be settled within 7–30 days (as per agreement).
  • Late payments attract interest charges and may result in service suspension.
  • Additional charges such as demurrage, detention, warehousing, penalties, or reworking fees are the customer’s responsibility.

6. Liability, Insurance & Risk

Cargo People takes every precaution, but due to the complex nature of international trade, liability is limited.

Key principles:

  • We are not responsible for delays or damages caused by carriers, customs, strikes, or force majeure.
  • Liability, if proven, is limited to service charges paid to Cargo People, not the value of goods.
  • Customers are strongly encouraged to obtain marine cargo insurance.
  • We do not assume liability for loss of profits, indirect or consequential damages.

7. Termination & Suspension of Services

Cargo People reserves the right to suspend or terminate services in cases of non-payment, misuse, or violation of laws. Customers may also terminate services with written notice, but all accrued charges remain payable.

8. Intellectual Property & Website Usage

Our website content, branding, images, and resources are protected under copyright law. Customers may not copy, modify, or distribute without permission.

9. Privacy & Data Protection

We handle personal and shipment data in accordance with our Privacy Policy, which complies with Indian IT Act, GDPR (Europe), and CCPA (California).

10. International Trade Compliance

Cargo People strictly adheres to trade sanctions and regulatory frameworks. Customers must not attempt to ship prohibited goods, including:

  • Arms, ammunition, or explosives.
  • Narcotics, counterfeit goods, or wildlife products.
  • Items restricted under Indian DGFT or international sanctions.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India.
  • Disputes with Indian clients will fall under Delhi courts.
  • For international clients, arbitration may be conducted under UNCITRAL Arbitration Rules at a neutral venue.

12. Force Majeure

Neither party is liable for delays caused by events beyond control, such as natural calamities, war, terrorism, or cyber-attacks.

13. Changes to Terms

We may revise these Terms at any time. Customers should review this page periodically for updates.
