This becomes important because a compliance issue identified after arrival can quickly turn into a logistics problem. CBIC’s National Time Release Study 2025 analyzed 62,981 import Bills of Entry and reported average import release times of about 79 hours 04 minutes at seaports, 83 hours 41 minutes at ICDs and 39 hours 20 minutes at Air Cargo Complexes. Shipments involving Partner Government Agency intervention generally took longer.

For importers, the practical sequence should be clear: understand the product, identify applicable regulations, verify approvals, check documents and only then authorize shipment.

Why Product Compliance Problems Usually Start Before Cargo Reaches India

Most import delays appear to be customs problems because that is where the issue becomes visible. In reality, the mistake may have happened several weeks earlier when procurement finalized the supplier without checking the regulatory position of the product.

Consider an importer purchasing 2,000 Bluetooth-enabled electronic devices from China. The supplier completes production, sends the commercial invoice and informs the buyer that the goods are ready. Because the product is required urgently, the logistics team books air freight and expects delivery within a few days.

During customs document preparation, the broker asks for the technical datasheet and discovers that the device contains Bluetooth. That immediately creates a WPC applicability question. A deeper review may then show that BIS, E-Waste EPR, Battery EPR or LMPC also need to be checked.

At this stage, the commercial problem has already become larger. Production is complete, freight may already be booked and the Indian buyer may have committed delivery dates to customers. If the cargo moves before the regulatory position is clear, the importer may face storage, documentation amendments, additional customs coordination and delayed delivery after arrival.

This is why product compliance should be treated as part of procurement and logistics planning. It should not begin only when the Bill of Entry is being prepared.

Why a Product Certification Check Before Import Is Essential

India does not have one universal licence that determines whether every product can be imported. Different regulatory requirements apply depending on the technical characteristics of the product, its HS classification, manufacturing source, wireless capability, battery configuration, packaging and intended use in India.

A commercial invoice often does not contain enough information to make that decision. A description such as “electronic controller”, “smart device” or “electrical equipment” may look clear for commercial purposes, but it tells very little about the regulatory requirements attached to the product.

An electronic controller, for example, may contain a Wi-Fi module, Bluetooth connectivity, an internal lithium battery, a power adapter or another component covered by a specific Indian Standard. None of those technical characteristics may be visible from the invoice description alone.

The compliance review should therefore begin with the actual product specification. Importers should examine the exact model number, manufacturer, factory location, technical datasheet, electrical characteristics, wireless features, battery type, packaging format and intended application.

This becomes even more important when a company imports a large number of SKUs. If an importer handles 100 or 200 different products, applying one compliance assumption across the entire catalogue can create unnecessary risk. Two products sold under the same commercial category may still have different BIS, WPC, EPR or LMPC requirements.

The purpose of a Product Certification Check Before Import is therefore not to collect certificates unnecessarily. It is to answer one practical question before shipment: can this exact SKU, manufactured at this exact facility, be imported into India under the proposed commercial and regulatory structure?

Product Certification Check Before Import – BIS, WPC, EPR and LMPC

BIS, WPC, EPR and LMPC regulate different aspects of an imported product. Understanding the difference between them is important because one approval does not automatically satisfy another requirement.

BIS primarily deals with conformity to applicable Indian Standards where certification has been made compulsory. WPC becomes relevant for products using certain radio-frequency technologies such as Wi-Fi, Bluetooth and other wireless communication systems. EPR focuses on environmental responsibilities associated with products such as electrical and electronic equipment, batteries and plastic packaging. LMPC deals with Legal Metrology requirements applicable to certain pre-packaged commodities sold or distributed in India.

The complexity increases when these requirements overlap. An importer may purchase a rechargeable smart home device that uses Wi-Fi and Bluetooth, contains an integrated battery and is sold in printed retail packaging. The finished product may require a BIS check, WPC review, E-Waste EPR assessment, Battery EPR assessment, Plastic EPR assessment and LMPC review.

This does not mean every imported smart device automatically requires all six approvals. Applicability depends on the exact product, technical configuration, business model and regulatory framework. However, it demonstrates why an importer should never rely on a supplier’s general statement that the product is “India compliant”.

A proper regulatory review should map each requirement separately and then bring them together into one product-level compliance matrix.

BIS Certification for Imports – What Importers Actually Need to Check

BIS certification is one of the most important pre-import checks for many electrical, electronic, industrial and consumer products. However, the first question should not be how to obtain BIS certification. The first question should be whether the exact product is covered by a mandatory Indian Standard or Quality Control Order.

Not every Indian Standard automatically creates a mandatory certification requirement. However, once a product is brought under compulsory certification, imported goods must comply with the applicable Indian framework. A foreign supplier may already hold CE, IEC or other international certifications, but these approvals do not automatically replace a mandatory Indian certification requirement.

The manufacturing facility is also important. Under relevant BIS routes for foreign manufacturers, certification is connected to the manufacturer, product, applicable standard and manufacturing location. An importer should therefore verify whether the licence actually covers the factory producing the goods.

This becomes particularly important when dealing with large international manufacturers. A supplier may operate 5, 10 or even 20 plants in different countries. A BIS licence issued for one facility should not automatically be assumed to cover production from another factory.

Model and product scope also require attention. If the supplier’s certificate covers Model ABC100 but the commercial invoice shows ABC100X, the importer should verify whether the variation is actually included within the approved scope instead of assuming that the difference is insignificant.

The commercial value of this check can be substantial. Assume an Indian manufacturer orders 100 pieces of industrial electrical equipment at ₹2.5 lakh per unit. The shipment value is already ₹2.5 crore before freight, customs duty and inland logistics. Discovering a mandatory BIS issue after production is complete can become much more expensive than identifying the same requirement during the quotation stage.

A useful 2026 process change is that FMCS application submission moved to the online route from 1 June 2026. For importers, the broader lesson is that compliance procedures change regularly. A regulatory checklist created in 2023 or 2024 should not automatically be treated as current in 2026.

WPC Certification for Importers – Wi-Fi, Bluetooth and RF Products

WPC applicability is often missed because wireless functionality is now built into products that do not appear to be traditional telecom equipment. A smart appliance, industrial sensor, printer, security device, machine controller or laboratory instrument may contain Bluetooth or Wi-Fi even though those features are not obvious from the product name.

This is why the WPC assessment should be based on the technical datasheet rather than the commercial invoice. The importer needs to understand whether the device transmits or receives radio-frequency signals, which frequency bands are used and what type of equipment is being imported.

Eligible products operating in licence-exempt frequency bands may require Equipment Type Approval through the relevant WPC route. Current government information lists a ₹10,000 government fee for eligible ETA applications, although the overall cost of compliance may be higher when technical testing, documentation or professional support is required.

Not every RF product should be handled through the same route. Radar systems, jammers, drones and satellite-related equipment can involve different authorization requirements. Treating all wireless products as ordinary Bluetooth devices can therefore lead to the wrong compliance conclusion.

For importers, timing is the most important operational issue. Suppose a business imports 5,000 Bluetooth accessories for a seasonal launch. If the goods are shipped before WPC applicability is resolved, a regulatory hold at the airport can remove much of the speed advantage gained by paying for air freight.

The correct sequence is to check the wireless specifications first, determine WPC applicability second and arrange the freight booking only after the regulatory position is clear.

EPR Registration for Imports – Why One Product Can Create Multiple Obligations

Importers often talk about an “EPR certificate” as if EPR were a single registration. In practice, different EPR frameworks apply to different products and waste streams, and an imported SKU may trigger more than one assessment.

The most common EPR checks for general product importers involve electrical and electronic equipment, batteries and plastic packaging. These are separate areas of responsibility and should be reviewed separately.

Consider an imported wireless electronic device. The finished device may fall within an E-Waste category. Its integrated lithium-ion battery may create a separate Battery EPR requirement. The plastic packaging used for the retail product may create another obligation under the Plastic EPR framework.

The regulatory position becomes more significant as shipment volumes increase. An importer bringing 500 units once may see EPR as a limited issue. The same business importing 10,000 units every month is introducing 120,000 units into the Indian market over one year.

At that scale, compliance cannot be treated as an occasional customs document. It becomes part of the company’s operating model.

For this reason, EPR applicability should ideally be assessed before regular imports begin. Procurement, compliance, finance and logistics teams should work with the same product-level data so that import volumes and environmental obligations are not managed independently.

E-Waste EPR for Imported Electrical and Electronic Equipment

E-Waste EPR becomes relevant when the imported product falls within the covered electrical and electronic equipment categories and the Indian entity meets the applicable definition of a Producer.

The common mistake is assuming that environmental responsibility remains with the overseas manufacturer because that company physically produced the item. In many commercial structures, the Indian entity placing covered equipment into the domestic market can carry significant obligations.

For businesses importing multiple products, E-Waste compliance should be managed at SKU or product-category level. A general registration file sitting with the compliance department is not enough if the purchasing and logistics teams do not know which models fall within the registered scope.

An importer handling 50 electronic SKUs should maintain a working compliance sheet showing the product category, model, brand, supplier, annual import quantity and applicable EPR status. This allows compliance to be integrated into purchase planning instead of being reviewed only after customs documentation is prepared.

Volumes also need to be monitored throughout the year. A product imported in quantities of 500 units during the first quarter may grow to 5,000 units per month later in the year. The regulatory obligation should therefore be monitored as part of normal business operations rather than as a one-time registration exercise.

Battery EPR for Equipment Containing Batteries

Battery EPR is frequently overlooked because many products contain batteries without being sold commercially as batteries. A laptop, portable scanner, wireless speaker, industrial monitoring device or medical instrument may all contain batteries as part of a larger finished product.

Importers should therefore ask two separate questions. Are we importing batteries as standalone products, and are we importing products that contain batteries?

The second question is often the one that gets missed.

Suppose a company imports 15,000 handheld electronic devices during one financial year. Each device contains one lithium-ion battery. From a sales perspective, the company imported 15,000 finished devices. From a battery-compliance perspective, it also introduced 15,000 batteries into the market as part of those products.

A proper review should capture the battery chemistry, type, approximate weight, application and commercial structure. This data becomes especially important for companies importing several product categories with different battery configurations.

Battery EPR should therefore be checked separately even when BIS, WPC or E-Waste requirements are also being reviewed for the same product.

Plastic EPR and Packaging Used for Imported Products

Packaging is often managed by procurement and marketing teams without much involvement from logistics or compliance until the shipment is already ready. For imported products, this can create unnecessary risk because plastic packaging may itself create an EPR consideration.

A single retail product can contain several types of packaging. It may have an outer plastic wrap, protective plastic inserts, a molded tray and a laminated package. When this is multiplied across 10,000 or 50,000 imported units, the total amount of packaging placed into the Indian market becomes commercially significant.

For example, if one imported unit contains just 40 grams of relevant plastic packaging, 25,000 units represent around 1,000 kilograms of plastic packaging. At 100,000 units per year, the same packaging structure represents approximately 4,000 kilograms.

This is why packaging should be considered during product compliance planning rather than after customs clearance.

A major 2026 procedural update was the migration of Plastic EPR users to the Common EPR Portal, with the previous portal discontinued from 28 June 2026. For importers, this highlights a wider issue: registration systems and compliance processes can change even when the product itself remains unchanged.

Businesses importing the same SKU year after year should therefore periodically revalidate their compliance process instead of assuming that an old checklist will remain correct indefinitely.

LMPC Registration for Importers – Why Packaging Can Stop an Otherwise Compliant Product

Legal Metrology is often discovered late because importers focus heavily on product certification and relatively little on what appears on the retail package.

A product can be technically compliant and still face a packaging-related issue if the applicable Legal Metrology requirements have not been addressed. Depending on the product, relevant declarations may include importer details, country of origin, common or generic product name, quantity, MRP and consumer-care information.

This creates an important distinction between technical product compliance and market packaging compliance. BIS may address whether a regulated product meets the applicable technical standard. LMPC addresses a different set of requirements for applicable packaged commodities.

The commercial consequences become larger when packaging volumes are high. Suppose an importer purchases 25,000 retail units from an overseas manufacturer. If the artwork is found to be incorrect before printing, the correction may require only a digital change and supplier approval.

If the same issue is discovered after 25,000 packs have been printed, packed and shipped, the importer may need to consider relabelling, warehousing, manpower, additional coordination and potential delay to market launch.

The practical sequence should therefore be artwork review first, packaging production second and shipment booking third.

Can One Imported Product Require BIS, WPC, EPR and LMPC Together?

Yes, and this is one of the most important points for modern product importers.

Take a hypothetical smart home device priced at ₹4,000 per unit. An Indian importer orders 10,000 units, making the commercial value approximately ₹4 crore before freight, customs duty, taxes and domestic transportation.

The device includes Wi-Fi, Bluetooth and an integrated lithium-ion battery. It is sold in retail packaging containing plastic components.

The importer may need to review BIS applicability for the product or associated electrical components, WPC for wireless functionality, E-Waste EPR for the finished equipment, Battery EPR for the integrated battery, Plastic EPR for packaging and LMPC for retail declarations.

This does not mean that all six requirements will always apply. It means the importer needs to check all six possible regulatory areas and document why each requirement either applies or does not apply.

At a shipment value of ₹4 crore, relying on assumptions is poor risk management. Even a small compliance issue can affect working capital, sales commitments, inventory planning and customs release.

A product-level compliance matrix is therefore one of the simplest ways to reduce avoidable risk.

The second stage is HS classification. The supplier’s overseas tariff code can be a useful reference, but the Indian classification should be reviewed independently because the HS code affects duty, DGFT policy conditions and potentially product-specific regulatory requirements.

The third stage is regulatory mapping. BIS, WPC, EPR, LMPC, DGFT and any other relevant government authority should be checked against the actual product rather than the commercial description alone.

The fourth stage is document verification. Model numbers should match across invoices and certificates. Manufacturer and factory details should be consistent. Product descriptions should be accurate enough for customs assessment without creating unnecessary ambiguity.

The fifth stage is shipment authorization. Once the compliance position and documentation are reasonably clear, the logistics team can proceed with air freight, FCL, LCL or another transport mode.

A pre-shipment document review should therefore be completed before the container is gated in or the cargo is delivered to the airline terminal.

Customs clearance is much more than duty calculation. The Bill of Entry provides Customs with information about classification, value, origin and the regulatory position of the imported goods.

Under Section 46 of the Customs Act, the Bill of Entry can be filed up to 30 days before the expected arrival of the vessel, aircraft or vehicle. This gives importers an opportunity to prepare documentation before the cargo physically reaches India.

Advance preparation becomes particularly valuable for regulated products. If certificate information, technical documents and product descriptions are reviewed during the transit period, the customs team has more time to identify inconsistencies before they become an arrival-day problem.

Why Government Agency Intervention Can Increase Clearance Time

CBIC’s release-time data also shows why regulated imports require more planning than ordinary cargo.

At seaports, the overall average import release time was approximately 79 hours 04 minutes. For consignments involving Partner Government Agency intervention, the average increased to about 129 hours 15 minutes.

That is a difference of more than 50 hours.

At Air Cargo Complexes, the overall average was approximately 39 hours 20 minutes, while consignments involving PGA intervention averaged around 66 hours 21 minutes. At ICDs, the corresponding figures were approximately 83 hours 41 minutes overall and 119 hours 28 minutes where PGA intervention was involved.

Not every BIS, WPC or other regulatory shipment will experience these exact delays. The numbers are useful because they demonstrate a broader operational pattern: additional regulatory intervention can increase the time required before cargo is released.

For importers handling urgent cargo, these differences matter. A company may spend significantly more on air freight to save 7 or 10 days compared with sea freight, only to lose several days because product approval was not checked before dispatch.

Why Compliance Delays Matter at High-Volume Gateways

JNPA provides useful context for understanding the scale of Indian containerized imports and exports.

During FY 2025-26, JNPA handled approximately 8.17 million TEUs compared with around 7.30 million TEUs in FY 2024-25. This represented growth of about 11.94 percent.

Total cargo handled during FY 2025-26 reached approximately 102.01 million tonnes.

For an individual importer, one 20-foot or 40-foot container may represent an urgent customer order or several months of inventory. At a major gateway, however, that container is moving through a system that handles millions of TEUs every year.

Terminals, customs authorities, shipping lines, CFS operators and transporters therefore work through structured processes. If a shipment lacks a required approval, the system does not stop while the importer determines what should have been checked before departure.

Preparation remains the responsibility of the importer and the professionals supporting the shipment.

How a Certification Error Turns Into a Logistics Cost

A compliance problem can affect far more than customs clearance time.

The landed cost of an import may already include international freight, origin handling, destination charges, customs brokerage, duty, IGST, insurance and local transportation. When a shipment is held, new costs can begin to appear.

Depending on the shipment, additional exposure may include terminal storage, CFS charges, container demurrage, detention, document amendment costs, broker coordination and transport rescheduling.

There is no single demurrage rate applicable across India. Charges depend on factors such as shipping line, terminal, container type, free period and length of delay.

A hypothetical example makes the impact easier to understand. Assume a 40-foot container carries goods worth ₹35 lakh. After the applicable free period, assume the combined incremental cost attributable to the delay in that specific case works out to around ₹10,000 per day.

A 5-day delay could create approximately ₹50,000 of additional direct logistics cost. A 10-day delay could increase that amount to around ₹1 lakh.

The larger business impact may still be outside logistics. If the goods are raw materials required for production, a plant stoppage can cost far more than the storage bill. If the shipment contains retail inventory for a launch, the company may lose sales during the delay.

The purpose of pre-import compliance is therefore not merely to avoid penalties. It is to protect the complete commercial timeline.

Documentation Errors Can Also Increase Customs Release Time

Not every customs delay is caused by a missing licence. Ordinary document errors can also increase the time required to release cargo.

CBIC’s 2025 study showed that Bills of Entry involving amendments generally recorded longer release times. At seaports, overall average release time was approximately 79 hours 04 minutes, while amendment-related Bills of Entry averaged around 91 hours 21 minutes.

At ICDs, the difference was larger. Overall average release time was approximately 83 hours 41 minutes, while Bills of Entry involving amendments averaged around 117 hours 25 minutes.

Not every amendment relates to BIS, WPC, EPR or LMPC. Amendments can occur for many customs and commercial reasons. However, the figures demonstrate that correcting information after filing can consume additional time.

For regulated products, the importer should therefore make sure that the HS code, model, manufacturer, certificate information and commercial description have been reviewed before the Bill of Entry is filed.

A 20-minute document check at origin can be much easier to manage than a correction after the cargo has arrived.

Common Reasons Regulated Imports Get Delayed

The most avoidable import problems are usually not caused by complex regulations. They are caused by incomplete product information and poor coordination between procurement, compliance and logistics teams.

A procurement team may accept the supplier’s HS code without checking Indian classification. A BIS certificate may cover another factory. The certificate may show one model while the invoice uses a slightly different variant. The product may contain Bluetooth even though the commercial description makes no reference to wireless technology.

Battery compliance can also be missed when the battery is integrated into the equipment rather than imported separately. Packaging requirements may be overlooked because artwork approval is managed by a marketing team that has little interaction with customs or regulatory teams.

Timing is another major problem. An importer may correctly identify that an approval is required but still allow cargo to move while the application remains pending.

This converts a regulatory lead-time problem into a logistics problem.

A good internal principle is simple: if a mandatory approval is still unresolved, shipment authorization should also remain unresolved unless there is a clearly validated legal basis for proceeding.

Bluetooth Electronics From China

Assume an importer purchases 2,000 Bluetooth-enabled devices from Shenzhen at ₹3,500 per unit. The commercial value is approximately ₹70 lakh.

Because the goods are required urgently, the buyer selects air freight. The supplier uses a short invoice description such as “electronic device” and sends the cargo toward India.

During pre-arrival document preparation, the customs team reviews the technical datasheet and identifies Bluetooth functionality. The WPC requirement now needs to be checked. Further review identifies possible BIS and EPR considerations.

The shipment may have reached India in only a few days, but the entire reason for choosing air freight is weakened if the product cannot proceed smoothly through clearance.

This scenario shows why freight speed and customs readiness should never be treated separately.

Industrial Electrical Equipment and BIS

Consider an Indian manufacturer purchasing 20 industrial electrical units from Europe at ₹8 lakh per unit. The equipment value is approximately ₹1.6 crore.

The supplier provides CE documentation and international technical reports. The procurement team assumes the equipment is compliant and authorizes sea freight.

During customs preparation, the importer identifies a potential mandatory Indian certification requirement. By that point, production is complete and the container is already on the water.

The importer now has ₹1.6 crore of equipment tied to a shipment that may require additional regulatory action. The factory may also have planned installation and commissioning around the expected arrival date.

Correct Product but Incorrect Retail Packaging

Suppose a consumer-goods company imports 25,000 units of a technically compliant product.

The required technical approval has already been checked, so the procurement team assumes everything is ready for shipment. The overseas supplier prints the complete retail packaging and dispatches the goods.

Later, the importer identifies an issue with the applicable Legal Metrology declarations.

If the same issue had been found during artwork approval, it might have required a simple digital correction. Once 25,000 units have already been produced and shipped, the problem becomes operationally much larger.

Air Freight vs Sea Freight When Product Approval Is Still Pending

Air freight and sea freight solve different logistics problems, but neither solves a regulatory problem.
